WELCOME TO THE SINGHEALTH HEALTH BUDDY app!
PLEASE READ THESE TERMS AND CONDITIONS (INCLUDING OUR DATA PROTECTION POLICY [Click here to view HB Privacy Policy] ) (“App Data Protection Policy”) CAREFULLY BEFORE USING THIS APP AND/OR THE SERVICES OR FUNCTIONS OF THE APP AND WEBSITES CONNECTED SO THAT YOU ARE AWARE OF YOUR LEGAL RIGHTS AND OBLIGATIONS WITH RESPECT TO SINGAPORE HEALTH SERVICES PTE LTD AND/OR ITS RELATED CORPORATIONS (INDIVIDUALLY AND COLLECTIVELY, “SINGHEALTH ”, “WE”, “US”, AS THE CASE MAY BE).
These Terms and Conditions (together with the documents referred to in it which are hereby incorporated by reference) (collectively, “App T&Cs”) informs you of the terms on which you may use our mobile app (“App”), whether as a guest or a registered user (collectively, a “User”). Use of the App includes accessing, browsing, or registering to use the app and the functions and services offered on or made available through the App (but excluding any functions or functionality of third party apps or content) (collectively “App Functions”).
By accessing and using the App and/or the App Functions, you hereby agree to be legally bound by these App T&Cs and you agree to comply with them.
If you do not agree to these App T&Cs, please leave the App and cease use of the App and/or the App Functions immediately.
We reserve the right to change, modify, suspend or discontinue the whole or any portion of the App Functions or the App at any time. We may also impose limits on App Functions or restrict your access to parts of or the entire App Functions, or the App without notice or liability.
We may from time to time modify, vary or amend these App T&Cs at any time by making the amended App T&Cs available or accessible by any means we deem fit, including by updating the App T&Cs at any link or location where the App T&Cs are accessible within or accessible from the App, or at other locations. Such modification, variation or amendment shall be effective immediately upon updating the App T&Cs at any such link or location, and will take effect whether or not you choose to review the revised App T&Cs. At our discretion, and without prejudice to the foregoing right to immediately modify, vary or amend the App T&Cs as stated, we may seek your explicit consent to agree to the App T&Cs and such consent would also include consent to any personal data preferences or instructions in relation to your personal data or the personal data of any caregiver or care recipient (see clause 7). Any use of the App Functions or the App after the amendment of these App T&Cs shall be deemed to be acceptance of the amended App T&Cs by you. If you do not agree to the amended App T&Cs, you have the right to close your account with us and/or cease your use of the App Functions.
1. Agreement
1.1 These App T&Cs govern your use of our App and the App Functions which are made available through the App.
1.2 By accessing the App you represent and warrant to us that:
a. You have read and agreed to the App T&Cs; and
b. You are at least 18 years old and have the necessary legal capacity, right, power or authority to agree to these App T&Cs.
2. Use of App and App Functions
2.1 We may offer various App and App Functions through the App, including without limitation, access to third party platforms (“Platform(s)”) such as the HealthXchange (https://www.healthxchange.sg/) platform (“ HealthXchange ”), HealthHub, SingHealth website (www.singhealth.com.sg) and other service providers such as Zoom Cloud Meetings.
2.2 You acknowledge and agree that to access and use certain App Functions and Platforms, you may be required to open an account and register as a User of the App and/or Platforms. In order to access HealthXchange, you shall be required to agree to and comply with additional terms and conditions of the HealthXchange Terms and Conditions (accessible at https://www.healthxchange.sg/terms-conditions) and such other terms and conditions, guidelines and rules which we will notify you of from time to time or which are incorporated into these App T&Cs by reference and apply in relation to any functionalities of HealthXchange.
2.3 To the extent that there are any inconsistencies or conflict between these App T&Cs and the terms and conditions governing HealthXchange or any of our other apps and websites, online service offerings or online platforms, the terms and conditions of our other websites, online service offerings or online platforms will prevail.
2.4 Where any other Platforms are used (including but not limited to any third party app or functionality identified or referenced in these App T&Cs, and all payment service functionalities including payment gateway functionalities, providers or services), these are operated or provided under separate terms and conditions by third parties, and we are not responsible for the functionality, performance or any incidences arising from or in connection with such Platforms. You agree to look for and review any such third party Platform terms and conditions and you may choose not to use those Platforms by not proceeding to engage any of their functions accessible or available through the App. These App T&Cs do not cover or apply to third party Platforms, including any content or their functionalities. You agree not to hold SINGHEALTH liable for the actions or default of such third parties or third party Platforms.
2.5 Transactions or instructions concluded on the App may require fulfillment by third parties (e.g., medical delivery services). Such third party services are not provided by the App and may be subject to the terms and conditions of the applicable third party. You agree not to hold SINGHEALTH liable for the actions or default of such third parties.
3. Intellectual Property Rights
3.1 The intellectual property rights in and to the App, App Functions and all the content of the App, including the designs, text, information, news, listings, graphics, images, videos, logos and button icons, editorial content, notices, applications, software (including HTML-based computer programs), music, sound and other files and their selection and arrangement (“ Content ”) are either owned by us or are licensed to us.
3.2 The trademarks, logos and service marks (" Marks ") displayed on the App are the property of SINGHEALTH or other third parties, and all rights to the Marks are expressly reserved by SINGHEALTH or relevant third parties. You are not permitted to use any Marks without the prior written consent of SINGHEALTH or such third party. The name of SINGHEALTH or any other Marks may not be used in any way, including in any advertising or publicity, or as a hyperlink without the prior written permission of SINGHEALTH.
3.3 The domain name on which the App is hosted on is the sole property of SINGHEALTH and you may not use or otherwise adopt a similar name for your own use.
4. Use of App Content
4.1 You may not reproduce, modify, adapt, translate, publish, display, communicate, transmit, broadcast, frame, scrape, podcast, webcast, distribute, sell, trade or exploit for any commercial or other purposes, any portion of, or any access to (unless otherwise expressly permitted in accordance with written law or with our prior written consent):
a. the App;
b. any of the App Functions;
c. any Content, except to the extent expressly permitted in these App T&Cs; or
d. any other content submitted, distributed or otherwise reproduced by any person accessing or using the App, the App Functions or any third party content (“Third Party Content”) except with the prior written consent of SINGHEALTH and the owner of such Third Party Content.
4.2 Without prejudice to the generality of the foregoing, you agree not to reproduce, display or otherwise provide access to the App and/or the App Functions, Content or Third Party Content on another app, website or server, for example through linking, framing, mirroring or any other technological means whether available now or in the future unless the prior written consent of SINGHEALTH is obtained.
4.3 You may, provided you have kept all copyright and other proprietary notices intact, download or print one copy of the information available on the App for your personal, internal and non-commercial use only. Permission to reprint or electronically reproduce any part of the App, App Functions, Content or Third Party Content whether in whole or in part for any other purpose is expressly prohibited without SINGHEALTH’s prior written consent, and the written consent of the owners of Third Party Content.
4.4 You may not decompile, reverse engineer or otherwise attempt to discover the source code of any SINGHEALTH Content available on the App or provided through an App Function except under the specific circumstances expressly permitted by law or SINGHEALTH in writing. The use of Third Party Content and third party functions or functionality is subject to third party terms and licences.
4.5 Without prejudice to the rights and remedies which are available to us at law, we reserve the right to terminate the privileges of any User who repeatedly breaches Clauses 3 and/or 4.
5. User Conduct
5.1 The App and App Functions are made available for your personal, non-commercial use only. Businesses, organizations or other legal entities may not use the App or App Functions for any purpose.
5.2 You represent and warrant and undertake to us as follows:
a. any content which you submit to the App or via the App Functions shall not:
i. be illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable;
ii. consist of or contain software viruses, commercial solicitation, chain letters, mass mailings, or any form of “spam”;
iii. contain content or statements contrary to public interest, public morality, public order, public security, national harmony, or otherwise be prohibited by applicable Singapore laws or regulations;
b. to comply with these App T&Cs, and such other notices or guidelines that may be posted on the App by SINGHEALTH from time to time (which are hereby incorporated by reference into these App T&Cs);
c. not to use any App Function or Content for any unlawful purpose, and to comply with all applicable laws and regulations, including without limitation, copyright law;
d. not to hack into, interfere with, disrupt, disable, over-burden or otherwise impair the proper working of the App or the App Functions, including without limitation denial-of-service attacks, spoof attacks, session hacking, sniffing, tampering, reverse engineering or reprogramming;
e. not to use the account of another User at any time for any purpose, whether with or without his/her permission;
f. not to use any information obtained from the App or the App Functions to harass, abuse or harm another person;
g. not engage in advertising to, or solicitation of, any User of the App to buy or sell any products or services through the App;
5.3 You understand and agree that SINGHEALTH may review and edit or delete (but has no obligation to do so) any content, messages, photos or profiles, or terminate your use of the App for any conduct or behaviour which we consider, in our sole discretion, and without reference or notice to you, to be undesirable, which violates these App T&Cs or which may be offensive, illegal or violate the rights, harm, or threaten the safety of any Users. The determination of whether this has occurred will be in the sole judgment and discretion of SINGHEALTH. We may retain such evidence of conduct or any records as evidence to substantiate our rights or to enforce our legal rights.
5.4 The following are some examples of the types of content and activities which are illegal or prohibited on the App or referred to in clause 5.3:
a. content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
b. activity that harasses or advocates harassment of another person;
c. transmitting "junk mail", "chain letters," or unsolicited mass mailing or "spamming";
d. engaging in advertising to, or solicitation of, any User to buy or sell any products or services through the App Functions;
e. promoting information or submitting content that is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;
f. creating restricted or password-only access pages or hidden pages or images (those not linked to or from another accessible page);
g. providing material that exploits people under the age of 18 in a sexual or violent manner, or soliciting the personal information from anyone under 18;
h. soliciting passwords or personal identifying information for commercial or unlawful purposes from other Users;
i. providing commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes.
j. modifying, adapting, translating, or reverse engineering any portion of the App or the App Functions;
k. removing any copyright, trademark or other proprietary rights notices contained in or on the App or the App Functions.
l. using any robot, spider, site search/retrieval application, or other device to retrieve or index any portion of the App or the App Functions;
m. reformatting or framing any portion of the app pages that are part of the App or App Functions;
n. creating User accounts by automated means or under false or fraudulent pretenses;
o. falsely representing or implying that any content submitted by you is sponsored or endorsed by SINGHEALTH;
p. submitting content that infringes, misappropriates or violates the intellectual property, publicity, privacy or other proprietary rights of any party; or
q. transmitting any viruses, worms, defects, Trojan horses or other harmful elements;
5.5 SINGHEALTH has the right (but is not obliged) to investigate and take appropriate action in its sole discretion against any person who posts such content on the App or partakes in any such activities including without limitation to any of the foregoing, removing the offending content from the App and/or terminating the account of any Users which breach these App T&Cs.
5.6 SINGHEALTH has the right (but is not obliged) to, remove or disable access to any materials (including content submitted by Users, third party apps and Third Party Content) that we determine in our sole discretion to be unlawful, fraudulent, threatening, libellous, defamatory, obscene or otherwise objectionable, or infringes or violates any party's intellectual property, other proprietary rights, these App T&Cs or for any other reason whatsoever. Any such editing or removal of any such content shall be without prejudice to our other rights and remedies available at law.
5.7 You acknowledge and agree that we cannot be responsible or liable for any content submitted onto the App by any Users or any third party apps or Third Party Content, and you agree to exercise access and use such content only at your own risk and with care and discretion.
6. Your Account and Password
6.1 If you choose, or you are provided with, a User name, code, password or any other piece of information as part of our security procedures, you must treat such information as confidential and you must not disclose it to any third party. You also agree that you will be the only authorized User of the App and/or the App Functions using your User name and password. You agree not to provide or make known your User name and password to any other person for any purpose, including to facilitate that person's access and unauthorized use of the App and/or the App Functions.
6.2 We have the right to disable any User identification code or password whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of these App T&Cs.
6.3 If you know or suspect that anyone other than you knows your User identification code or password, you must promptly notify us at pdpa@singhealth.com.sg.
7. Caregivers & Care recipients
NOTE: Prior to this edition of the terms and conditions, and for security and other reasons, any changes or updates to your preferences to act as a caregiver or, as a care recipient, to grant or withdraw consent to any person to use the App to act as your Caregiver, would have had to been done in person at a SingHealth counter, with proof of your identity. Hereafter, any revocation would need to be done via the HealthHub app, as we may require.
Even though every effort will be made to update your decisions, you should expect us to take a reasonable period of time to implement them.
7.1 If you are above the age of 21 years old, you may appoint another person (a “Caregiver”) to access on your behalf your records, as may be selected by you. Upon his/her acceptance of the appointment as your Caregiver, your Caregiver would be granted access to your selected records, and this would allow your Caregiver to, amongst other things, make appointments, access and review your medical records, and/or make payments etc., on your behalf. You may revoke your Caregiver’s rights at any time, or as per any applicable revocation procedure as may be notified to you. AS PART OF THE MERGER OF E-SERVICES OF THE APP WITH THE HEALTHHUB PLATFORM, ANY CAREGIVER THAT PROCEEDS TO ACCEPT THESE APP T&CS WILL BE GRANTED THE SAME LEVEL OF ACCESS THAT A CARE RECIPIENT HAS GIVEN TO THE CAREGIVER UNDER HEALTHHUB, TO BE ACCESSIBLE VIA THIS APP. IF YOU ARE A CAREGIVER AND WISH TO PROCEED WITH THE USE OF THE APP AFTER CONSENTING TO THESE REVISED APP T&CS, YOU AGREE TO ONLY DO SO IN ACCORDANCE WITH THESE APP T&CS INCLUDING CLAUSE 7.8. You will indemnify and hold SINGHEALTH harmless from and against any claims or loss of any description as may arise from or in connection with any of your activity in relation to the breach of this clause.
7.2 You, as care recipient and/or Caregiver as the case may be, consent to us sharing the appointment of the Caregiver for the care recipient with the healthcare systems and applications operated or managed by the public healthcare institutions in order for the Caregiver to manage such healthcare services (including medical, dental, health-screening and immunisation services) and receive information (including AI-generated content) on recommendations and programmes related to the promotion of good health, healthy lifestyles and prevention and detection of diseases to be provided to you.
7.3 You, as a care recipient, shall be responsible for any and all activities and transactions carried out by your Caregiver on your behalf. We shall be entitled to rely on and you shall be bound by all electronic communications, requests, orders or messages made by or given through your Caregiver. We are not required to investigate or corroborate any instructions or mandate you may have given in relation to such activities and transactions and you must make any changes as you may need via the HealthHub app or as we may otherwise require, subject to clause 7.7.
7.4 If you are a Caregiver, you warrant in your capacity as Caregiver that you shall use the information which you are given access to solely for the benefit of the person who has appointed you as his/her Caregiver
7.5 We have the right to accept or reject any grant of Caregiver rights. We may also revoke a Caregiver’s right to access any person’s records at any time without prior notice.
7.6 A Caregiver’s access to your medical records will be disabled when successful revocation is done via the HealthHub app by you, as care recipient, as per any applicable revocation procedure as may be notified to you.
7.7 You agree that we will be entitled to take reasonable efforts and time to implement any instructions on revocation and that any reasonable time taken to do so will not be deemed to be a delay. You agree that you will give precise instructions and take such steps to authenticate your identify and instructions as we may require. We will not be liable for any incomplete, inaccurate, or unauthenticated instructions.
7.8 Where you are a Caregiver, you warrant and agree that you have the appropriate consents of care recipients to access, use or disclose their data, and you will not misrepresent or withhold any information as may be relevant to your rights to access the personal data of any other person. If you are not entitled, or become aware that you are not entitled, to access the personal data of any other person, but proceed to do so, you will indemnify and hold SINGHEALTH harmless from and against any claims or loss of any description as may arise from or in connection with any of your activity in relation to such persons.
7.9 If you are an adult Caregiver managing care recipients who are minors, you warrant and confirm that you are entitled to access their records and use the App to administer all functions in the App for the benefit of such minors, whether by reason of a legal guardian or parent relationship. If you are not entitled, or become aware that you are not entitled, to do so, you will indemnify and hold SINGHEALTH harmless from and against any claims or loss of any description as may arise from or in connection with any of your activity in relation to such minors.
8. Biometric Functions
8.1 In addition to the use of passwords, you may be able to use your fingerprint or face identification (“Biometric Data”) registered on a supported mobile device to confirm your identity (“Biometric Function”) to access certain functionalities, including but not limited to HealthUP!, Speciality Care and Downloads, within the App.
8.2 In order to use the Biometric Function, you must:
1. Register an account with us pursuant to Clause 2;
2. Install the App using a supported mobile device;
3. Activate the Biometric Function on your supported mobile device and register your Biometric Data to control access to the permitted mobile device;
4. Choose to use your supported mobile device’s Biometric Function to access the related functionalities within the App;
5. Ensure that only your Biometric Data is stored on your supported mobile device to access the device; and
6. Ensure the security of the passcode and the Biometric Data on the supported mobile device.
8.3 You acknowledge that upon successful registration of your Biometric Function in your supported mobile device, any such Biometric Data that is stored on your supported mobile device may be used to access the relevant functionalities within the App. We owe no duty to verify that the Biometric Data stored on your supported mobile device is indeed your Biometric Data. In addition, you acknowledge that you will need to secure your supported mobile device and that you will be solely responsible for all use of your supported mobile device (whether authorized by you or not) to access the Biometric Function on the App. All use or access of the relevant functionalities within the App through the use of your supported mobile device’s Biometric Function will be deemed to be used or accessed by you, whether such use or access was authorised by you or not.
8.4 The Biometric Function of your supported mobile device is not provided by SINGHEALTH or the App, and we are not responsible for the security of the Biometric Function of any supported mobile device and whether it works in the way represented by the manufacturer of your supported mobile device. In addition, the use of the Biometric Function of your supported mobile device may be subject to third party terms.
8.5 You acknowledge that the Biometric Function on the App may not be accessible at all times.
8.6 For the purposes of this Clause 8, a supported mobile device means a supported mobile device that we may enable for use with the App and includes the operating system or software that the device operates on. If the operating system of your mobile device is listed in the relevant application store from which you have downloaded the App (including but not limited to the Apple App Store and Google Play Store) your mobile device would be a supported mobile device.
8.7 Requests for biometric authentication, which comprises use of the Biometric Function on your mobile device using Biometric Data, may be facilitated through the use of third party Platforms. Where so, the biometric authentication function will be enabled subject to your agreement to (and compliance with) such third party Platform terms and conditions, which may be updated by such third party Platform service providers from time to time. SINGHEALTH is not responsible for or liable for the content of such terms and conditions / terms of use, and you agree not to hold SINGHEALTH liable for the actions or default of such third parties. You will indemnify and hold SINGHEALTH harmless from and against any claims or loss of any description as may arise from or in connection with any breach by you of such terms and conditions / terms of use.
9. Payment Services
9.1 You may be redirected to another third party Platform to enable you to make payments to specific health care institutions and/or other vendors. You acknowledge that we are merely an intermediary to facilitate payments made by you, and that such re-direction by us of you to the payment platform is provided for your convenience only. All payments made through the payment platform are made directly to the accounts of the billing parties.
9.2 Third party services may be used to verify, secure and/or process your payments. The third party services may charge a fee for processing payments related to your transactions as carried out on outside of this App and you shall be responsible for all payment processing fees incurred.
9.3 Without prejudice to the other provisions of these App T&Cs, we shall not be responsible for any malfunction in any computer system, software or any internet access service provider that may affect the accuracy or timeliness of the online transmission of payment instructions. We shall not be responsible if any information provided is inaccurate or if payment instructions are not given sufficiently in advance to allow for timely payment or if payment instructions cannot be carried out by third party Platform or third party services for any reason beyond our control.
10. Video Consultation, Tele-Consultation and TeleHealth Services
10.1 Various healthcare/telehealth services may be offered by the App on the Platforms, including medical consultations and other health and wellness services (“Healthcare Services”).
10.2 If you use any video consultation, tele-consultation or TeleHealth functionalities (a “Virtual Consultation” or collectively, “Virtual Consultations”), you acknowledge and agree that:
a. You may arrange and schedule Virtual Consultations with healthcare professionals who will deliver the Healthcare Services (“Healthcare Professionals”) if determined that you are eligible for such Virtual Consultation;
b. All requests or appointments for Virtual Consultations shall be subject to the Healthcare Professionals’ acceptance in their sole discretion and each consultation accepted by a Healthcare Professional shall constitute a separate agreement between the Healthcare Professional and you, to which SINGHEALTH is not a party to;
c. The Healthcare Professionals are entitled to exercise independent judgement and may make a decision, in their sole judgement and discretion, as to whether a Virtual Consultation is appropriate. Each Healthcare Professional is responsible for his/her Healthcare Services rendered to you and compliance with the requirements of his/her profession and licence. Each Healthcare Professional shall be entitled to decline any Virtual Consultation at their sole judgement and discretion;
d. The App merely services as a provider of the Platforms, and other supporting services, and does not provide or engage in Healthcare Services. Neither the App, SINGHEALTH nor any third parties who promote the Healthcare Services, facilitate the provision of the Healthcare Services or provide you with a link to the Healthcare Services or the Virtual Consultation shall be liable for any professional advice you obtain from a Healthcare Professional via the App or the Platforms. Neither SINGHEALH nor the App shall be liable for any referrals made by a Healthcare Professional via the App or Platforms to any third parties, including but not limited to specialists or laboratories. SINGHEALTH does not take on any duty of care to you;
e. The Virtual Consultations will be conducted on platforms of other service providers such as Zoom Cloud Meetings, a secure online video conferencing platform approved by the Ministry of Health for video conference consultation. It is your responsibility to ensure that (i) your device is connected to an internet connections of sufficient quality and strength to smoothly host a Virtual Consultation; and (ii) the Virtual Consultation is conducted in conducive environment that is sufficiently private, adequately lit and which has the appropriate equipment or facilities as may be required. For avoidance of doubt, a Virtual Consultation comprises a real-time two-way interactive audio or audiovisual consultation;
f. Once your request is accepted or appointment is made, the App may provide your information to the Healthcare Professional, including your name and identification number. You agree to provide proof of identity (which includes a valid photo identification(such as NRIC), company identification and/or insurance card) and such information as requested by the Healthcare Professional to verify your identity at the start of or at any time during the Virtual Consultation. You acknowledge that you may be denied Healthcare Services if you refuse to provide proof of identity or assume a false identity. The Healthcare Professional reserves the right to decline any request for virtual consultation through the App in its absolute discretion;
g. You agree that you shall be subject to and comply with the applicable policies and procedures for any change or cancellation of appointment for a Virtual Consultation;
h. You acknowledge that there are inherent limitations to Virtual Consultations and that in respect of certain medical situations, physical consultations may be a more appropriate medium for medical evaluation, diagnosis and/or consultation. Such medical situations may include, but are not limited to: (i) situations requiring urgent care or emergency conditions; (ii) serious conditions (e.g. breathlessness, severe or persistent pains, chest pains, cardiac arrest); (iii) chronic conditions which have not been previously diagnosed by a doctor; (iv) any condition requiring further investigations including but not limited to laboratory tests, and imaging modalities; (v) medical conditions that cannot be adequately assessed through video consultation (e.g. suspected stroke or pneumonia); or (vi) specific types of medication (e.g. controlled drugs, medication with addictive potential such as codeine-containing products, opioids, hypnotics or benzodiazepines). Should you require urgent medical care, please seek attention at the nearest medical facility or emergency department or call 995. For conditions that cannot be safely assessed or treated without a physical consultation, the Healthcare Professional may advise you to seek face-to-face medical attention for further assessment;
i. The applicable fees for the Virtual Consultation and Healthcare Services will apply, and shall be paid through the payment methods made available or offered by the Healthcare Professional;
j. The Healthcare Services are intended to be provided to Users in Singapore and the Healthcare Professionals are qualified/licensed to consult/treat Users within Singapore. Please consult your Healthcare Professional for any requests for Virtual Consultations to be held under circumstances where you are not located within Singapore;
k. The App and SINGHEALTH does not, and shall not be deemed to, direct or control the Healthcare Professional generally or in the Healthcare Professional’s performance under these App T&Cs specifically, including in connection with the Healthcare Professional’s provision of Healthcare Services or the Healthcare Professional’s acts or omissions;
l. Any opinions, advice or information expressed by the Healthcare Professional are those of the Healthcare Professional alone and they do not reflect the opinions of the App nor SINGHEALTH;
m. You are solely responsible for the correctness and accuracy of the particulars, statements and images including your symptoms, health history, photographs, laboratory test results or diagnostic images furnished/uploaded by you to the Healthcare Professional;
n. You shall comply with any advice by any Healthcare Professional to consult a doctor or other healthcare professional in person or seek emergency or other treatment;
o. Medication delivery may be offered as part of the Virtual Consultation. You shall (i) comply with any instructions given in relation to any prescription provided to you including, in particular, route, timing and dosages; (ii) promptly report any side effects of any prescription to a doctor; (iii) check the labels of the medication prescribed to verify the medication matches the prescription before consuming the medication delivered; (iv) protect anything prescribed to you and not permit any other person access to the prescribed medication; and (v) not use any prescription after its expiry date;
p. Medical Certificates may be issued to you pursuant to the Virtual Consultation through the means specified by the Healthcare Professional;
q. You shall not record in any media your interactions with the Healthcare Professionals through the App or the Platforms. Should Healthcare Professionals require the consultation to be recorded as part of your health records, you expressly grant consent for recordings by the App, the Platforms and/or Healthcare Professional and for such recordings to be retained as part of your health records;
r. You shall not conduct yourself in an inappropriate manner when interacting with the Healthcare Professional, or display/upload any inappropriate or medically-irrelevant images to the App. Any such conduct may result in the termination or suspension of your account and/or deletion of the images from the App;
s. You shall comply with the App’s termination terms set out in Clause 15 below; and
t. You confirm that you have read, understood and consent to our App Data Protection Policy [Click here to view HB Privacy Policy].
11. Content & External Data Disclaimers, Limitation and Exclusions
11.1 Please note that the Content, any Third Party Content, third party Platforms or apps, which are accessible through or made available via the App and/or the App Functions are not intended to be, and should not be treated as, substitutes for professional medical advice, diagnosis or treatment except where specifically arranged by your medical service provider (i.e. your clinical care team, such as your doctor or allied health professional). Without prejudice to the foregoing, the Content and Third Party Content are provided on the understanding that no surgical or medical advice or recommendation is being rendered to you via either the App and/or the App Functions, with the exception of proper use of the Virtual Consultations as stated in Clause 10 above. Medical treatment has to be individualised and can only be rendered after adequate assessment of your condition through appropriate clinical examination. Please do not disregard the professional medical advice of your physician or local healthcare provider or delay in seeking medical advice from them because of any information provided on the App or via the App Functions. For the reasons given above, you should not rely on the information provided on the App or via the App Functions, with the exception of the proper use of Virtual Consultations as stated in Clause 10 above, and, to the fullest extent permitted by law, we do not accept any responsibility if you do. We give access through the App to such information without responsibility for accuracy and any errors contained in such information shall not be made the basis for any claim, demand or cause of action;
11.2 You further acknowledge that the App and App Functions are not intended or suitable for use in situations or environments where the failure or time delays of, or errors or inaccuracies in, the content, data or information provided by the App or the App Functions could lead to death, personal injury, or otherwise result in significant financial loss or business interruption. Virtual Consultation services are not for urgent or emergency care.
11.3 Any third party Platform, third party app, and any Content and Third Party Content posted, distributed or otherwise made available on the App (including through the App Functions) are not moderated by us. We are not responsible for the same, and we do not represent or hold out any service provider, Platform service provider or operator, or an author, editor or publisher of any Content or Third Party Content, as part of SINGHEALTH, or as “experts” or “content partners” or similar designations and you acknowledge and agree that any use by you of any of the foregoing is entirely at your own risk.
11.4 In addition, the App or App Functions may display, publish or make available content that is not provided or published by us (including for example, content provided by third party content aggregation services or information providers). Such content is the sole responsibility of the person or entity that makes it available. We are not responsible for such content, and we do not have control over the selection thereof, nor do we routinely monitor such content. SINGHEALTH makes no representations or warranties as to the veracity or accuracy of such content, the reproduction and use of which may be governed by the third party content provider’s terms of use.
11.5 SINGHEALTH does not verify and is not in a position to verify any party’s rights to submit any content on or through the App or App Functions, and SINGHEALTH takes no responsibility and assumes no liability, whether direct or indirect or any incidental, special, indirect or consequential damages whatsoever, including, without limitation, damages for loss of profits or any other commercial damages or losses, for any content posted by you or any third party, or for your use of the same. SINGHEALTH and its vendors believe their data and text services to be reliable but accuracy is not warranted or guaranteed.
11.6 You acknowledge and agree that SINGHEALTH does not endorse or recommend, is not an agent, reseller or distributor of, and has no control over any of the products or services which may be offered or made available by any third party (including via third party Platform or third party Content) on or through the App or the App Functions, and SINGHEALTH hereby expressly disclaims all liabilities and responsibilities arising in relation to any such products or services whether made available or accessible via the App or on a third party app or Platform.
11.7 Any company names, products, services and branding cited or used via the App or the App Functions may be (and in the case of third party Platforms or apps are) trademarks or registered trade marks of their respective owners and the owners retain all legal rights. The use of trade marks or service marks of another is not a representation that the other is affiliated with, sponsors, is sponsored by, endorses, or is endorsed by SINGHEALTH.
11.8 Health Buddy may enable you to access, amend and/or use data or information relating to you or other persons (e.g. your children or dependents) from other sources including but not limited to the Health Hub application (and related databases) and the National Electronic Health Record system managed by the Ministry of Health (“NEHR”) (“External Data”). All External Data are provided on an “as is” and “as available” basis. We are not responsible for the availability of or any inaccuracies, errors or omissions in such External Data. Use of External Data may be subject to terms and conditions imposed by external parties’. By using the App, you acknowledge and consent to the following:
a. The App’s access to and use of External Data;
b. The App enabling you to amend such External Data, in which case you agree to provide data which is accurate (to the best of your knowledge and ability) and without liability to SINGHEALTH in relation to such amendment;
c. The retention of your personal information and the External Data by the governmental bodies, public agencies, any other affiliates of MOH Holdings Pte. Ltd. and SINGHEALTH;
d. The use of your personal information and the External Data in aggregated or de-identified form for research, service improvement, statistical and planning purposes;
e. As may be applicable, the App sending you personalised health recommendations based on the available External Data.
12. Other Disclaimers of Warranties and Exclusions of Liability
DISCLAIMER: THIS SITE AND THE INFORMATION IT CONTAINS IS MADE AVAILABLE ON AN "AS IS AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.
12.1 You hereby acknowledge and agree that the App and App Functions may use transmissions over the Internet which are never completely private or secure and that any information transmitted to the App may not be confidential and you have no expectation of privacy with respect to such information, subject always to the App’s Data Protection Policy.
12.2 You agree that:
a. SINGHEALTH shall be entitled at any time, at its sole and absolute discretion and without prior notice, to add to, vary, terminate, withdraw or suspend the operation of the whole or any part or feature of the App or App Functions without assigning any reason; and
b. access to or the operation of the App and/or the App Functions may from time to time be interrupted or encounter technical or other problems and may not necessarily continue uninterrupted or without technical or other errors,
and in any such event, SINGHEALTH shall not be liable for any loss, liability or damage which may be incurred as a result.
12.3 To the maximum extent permitted by law, you irrevocably agree and acknowledge that:
a. The App (together with any App Functions or other third party provided functions contained in or performed or enabled by or through the App ) are provided on an “as is”, “where is” and “as available” basis, with all faults and without any warranty of any kind. Your use of the same is at your own risk and you are responsible for compliance with all applicable laws;
b. we do not warrant that the the App, any of the App Functions or other third party provided functions contained in or performed or enabled by or through the App will be free of interruption or that the same is free of viruses, worms, Trojan horses, other harmful elements or other code that manifest contaminating or destructive properties. SINGHEALTH is not responsible for telecommunications, network, electronic, technical or computer failures of any kind, inaccurate transcription of entry information, errors in any promotional or marketing materials, errors in these rules, any human or electronic error;
c. we give no warranties of any kind in relation to or in connection with any third party Platform, third party app, or other third party provided functions contained in or performed or enabled by or through the App , and each in case, for third party provided functions contained in or performed or enabled by or through the App, these are provided under separate terms and conditions of third parties, and we are not responsible for the functionality, performance or any incidences arising from or in connection with such Platforms;
d. we do not warrant that the App, the App Functions or other third party provided functions contained in or performed or enabled by or through the App will meet your requirements, that the operation of the same will be uninterrupted or error-free, or free of defects. Without prejudice to the foregoing, SINGHEALTH does not warrant and hereby disclaims any representation, warranty or term with respect to the App, the App Functions or other third party provided functions contained in or performed or enabled by or through the App, whether express, implied or statutory, including but not limited to:
i. merchantability, satisfactory quality, fitness for a particular purpose, title, accuracy, quiet enjoyment, and non-infringement of third party rights, or as to the accuracy, correctness, reliability, timeliness, non-infringement of or compliance with any laws, regulations and/or third party rights;
ii. the App or App Functions being compatible or working with any third party software, applications or third party services;
e. we shall bear no liability whatsoever in connection with the design, development or administration of any aspect of the App, the App Functions or other third party provided functions contained in or performed or enabled by or through the App, your interactions with the same or your participation in any App Functions;
f. we are not liable for any delay or failure of the App, the App Functions or other third party provided functions contained in or performed or enabled by or through the App, to perform.
12.4 You expressly acknowledge and agree that, to the maximum extent permitted by applicable law, use of the App and any App Functions or other third party provided functions contained in or performed or enabled by or through the App is at your sole risk and that the entire risk as to satisfactory quality, performance, accuracy and effort is with you.
12.5 Further, nothing in these App T&Cs constitutes any representation or warranty by us as to your rights (if any) to use any content submitted by any third parties, including Third Party Content, all of which representations and warranties are expressly disclaimed.
13. General Indemnity
13.1 You agree to indemnify, defend and hold harmless SINGHEALTH, its officers, directors, employees and agents from and against all claims, demands, losses, expenses, damages, costs and liability, including reasonable attorneys' fees, arising out of or in connection with any breach of these App T&Cs, any breach of any applicable law by you, your breach of any third party’s rights, your use of the App or the App Functions or any activity related to your use of the App (including but not limited to infringement of third parties' worldwide intellectual property rights or negligent or wrongful conduct) or any other person accessing the App using your User name and password.
13.2 This Clause shall survive the termination or expiration of these App T&Cs (howsoever caused).
14. Limitation of Liability
14.1 To the maximum extent permitted under applicable law, SINGHEALTH, our officers, directors, employees and agents shall not be liable for any claim, damage or loss of any kind of any nature whatsoever caused and howsoever arising as a result (whether direct or indirect) of or otherwise in connection with: (i) your use of or reliance on the App or App Functions, other third party provided functions contained in or performed or enabled by or through the App; and (ii) any Content, third party Platform, third party app or Third Party Content or other content or any other information made available or accessed on or through the App or contained in or available from the App or your use or reliance on. Without prejudice to the foregoing, the claim, loss or damage referred to includes but is not limited to any claim, damage or loss suffered (whether incidental, special, indirect or consequential) as a result of or in connection with any reliance on the foregoing or any infringement of any rights arising in connection therewith, including without limitation any loss of data, profits, goodwill, anticipated savings, reputation, business or business opportunity, regardless of the cause thereof and even if we have been advised of the possibility thereof.
15. Termination
15.1 We reserve the right to terminate or suspend your use of the App without prior notice to you, at any time and for any or no reason including inappropriate behaviour on the App. Without limiting the foregoing, if you breach these App T&Cs or conduct yourself in a manner that we deem to be detrimental to the integrity, security and operation of the App, the App Functions, other third party provided functions contained in or performed or enabled by or through the App, or any information systems connected or in operation with the same, we reserve the right to suspend or permanently terminate your access to the App and the App Functions for any reason in our sole and absolute discretion.
15.2 You agree and acknowledge that any suspension or termination of your access to the App may be effected without prior notice, and agree that the App may immediately deactivate. Further, you agree and acknowledge that to the maximum extent permitted under applicable law, we shall not be liable for the discontinuation or termination of your access to the App.
16. Personal Data
16.1 Our collection, use and disclosure of your Personal Data is governed by our App Data Protection Policy (Click here to view HB Privacy Policy), the terms of which are also incorporated into these App T&Cs by reference and apply your use of our App.
16.2 It is a continuing condition of your use of the App that you agree to the terms of our App Data Protection Policy as amended from time to time.
17. Emails & Correspondences
17.1 By providing your email address or registering as a User of the App, you acknowledge and agree to SINGHEALTH sending you emails relating to your account.
17.2 You can unsubscribe to e-mails at any time by clicking on the unsubscribe link in any of our email communications.
18. Links
18.1 While SINGHEALTH welcomes links to our App from other websites, we, in no way, operate, control or endorse linking sites and reserve the right to disallow any such link at any time in our sole discretion. Should you wish to link to our App, you must link to our home page at https://www.singhealth.com.sg/, and even then only with our written consent.
19. Security
19.1 We shall endeavour to use available technology to protect the security of communications made through the App. However, we do not accept any liability for the security, authenticity, integrity or confidentiality of any transactions and other communications made through the App that is beyond our reasonable control or managed by other third parties.
19.2 You acknowledge that internet communications may be susceptible to interference or interception by third parties, and that we make no warranties that the App is free of infection by computer viruses or other unauthorised software.
19.3 You are responsible for:
1. taking appropriate steps to keep your information, software and equipment secure, including clearing your internet browser’s cache (whether on your mobile device or otherwise) after using any features, services, tools, directories or content on the App; and
2. ensuring that your mobile device, including its operating systems and/or software, through which you use the App is maintained and kept up to date – neither SINGHEALTH nor the App will be responsible or liable for any security lapses or issues such as data loss arising from your failure to keep your mobile device, including its operating systems and/or software up to date.
20. Third Party Sites and Links
20.1 We may provide links to third party sites. We have no control over such third party sites, and you acknowledge and agree that we are not responsible for the availability of such external sites or resources, and do not endorse and are not responsible or liable for any content, advertising, products, services or materials on or available through such sites or resources, including Third Party Content. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with use of or reliance on any content, goods or services on or available through any such site or resource.
20.2 You further acknowledge that your access to and/or use of third party sites is entirely at your own risk, and that third party sites usually have their own terms and conditions, including privacy policies, over which we have no control and which will govern your rights and obligations with respect to the use of those sites and resources.
20.3 We do not warrant that the third party sites will meet your requirements or that the same will not cause you any loss of any kind, and you agree that to the maximum extent permitted by law, SINGHEALTH shall not be liable for any loss or damage of any kind incurred in connection with your use or reliance on any content, information or other materials on or available through such third parties.
21. General
21.1 You may not transfer any rights or obligations you may have under these App T&Cs. We reserve the right to transfer or to subcontract any right or obligation under these T&Cs at our sole discretion without your consent.
21.2 If any term or provision of these App T&Cs is found by a court of competent jurisdiction to be illegal, invalid or otherwise unenforceable, such term or provision shall not affect these App T&Cs’ other terms or provisions, or the whole of these App T&Cs, but such term or provision shall be deemed modified to the extent deemed necessary to render such term or provision enforceable, and the rights and obligations of the parties shall be construed and enforced accordingly, preserving to the fullest permissible extent the intent of the parties and these App T&Cs’ purposes.
21.3 Nothing in these App T&Cs shall constitute or be deemed to constitute an agency, partnership or joint venture between SINGHEALTH and you and neither party shall have any authority to bind the other in any way.
21.4 A person who is not a party to these App T&Cs has no right to enforce or enjoy the benefit of any term of these App T&Cs under the Contracts (Rights of Third Parties) Act 2001.
22. Governing Law
22.1 These App T&Cs shall be governed and construed in accordance with the laws of Singapore.
23. Arbitration
23.1 By accessing this App, you agree that final and binding arbitration shall be the sole and exclusive forum and remedy for any and all disputes and claims relating in any way to or arising out of these App T&Cs, (including your visit to or use of the App) or the App Functions, except to the extent that either you or SINGHEALTH have in any manner infringed upon or violated or threatened to infringe upon or violate the other party's patent, copyright, trademark or trade secret rights, then the parties acknowledge that arbitration is not an adequate remedy at law and that injunctive or other appropriate relief may be sought.
23.2 The reference to arbitration in these App T&Cs shall be a submission to arbitration within the meaning of the Arbitration Act 2001 for the time being in force in Singapore. Such arbitration shall be conducted in the English language in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (“SIAC Rules”) for the time being in force, which rules are deemed to be incorporated by reference into this Clause, except in so far as such Rules conflict with the express provisions of this Clause, in which event the provisions of this Clause will prevail.
23.3 The seat of the arbitration shall be Singapore. The arbitral tribunal shall consist of one (1) arbitrator to be appointed by mutual agreement between you and SINGHEALTH. Any party may propose to the other(s) the name or names of one (1) or more persons, one (1) of whom would serve as the arbitrator. If no agreement is reached within thirty (30) days after receipt by one (1) party of such a proposal from the other, the arbitrator shall be appointed by the President of SIAC. The arbitrator must not be a present or former employee or agent of, or consultant or counsel to, any party or any related corporation as defined in Section 6 of the Companies Act 1967 of any party.
23.4 Any decision or award of an arbitral tribunal appointed pursuant to this Clause will be final and binding on both you and SINGHEALTH and the execution thereof may be entered into any court having jurisdiction.
23.5 You undertake to keep the arbitration proceedings and all information, pleadings, documents, evidence and all matters relating thereto confidential.
